    Hi Lawyers, Not asking for any legal advice but maybe some clarification about what it means to serve without bond as an executor to a will? I read the explanation but don't understand it. I am in a horrible situation right now family-wise but can't clear my head enough to figure it out, anyone know? Thanks

    It means you don't have to put up any money (a bond) in order to do your job as an executor. It is a good thing.
    If you have been named the executor - hire a probate attorney. I'm a retired IP attorney who has written plenty of wills, but I hired a probate attorney for when I was executor of my Dad's will. They know the ins and outs.

    I am the beneficiary and the two executors of the Will I am not on good terms with right now. Should I consult a lawyer?

    My understanding is the executors pay outstanding bills and execute what the will stipulates, so I don’t think they have any legal way to not provide you what the will states. Seems like Lurker above would have better idea than me but that’s my two cents.

    Lurker and ajw2910 are correct. Being a beneficiary should be the easy part. As long as the assets exceed the debts, you'll receive what's left after everyone who should be paid is paid. The probate process is how they determine who should be paid what.

    FYI, if the decedent received any government benefit such as medicaid the IRS will want theirs too. Everything paid out will be taken back.

    Being an executor is a pain in the ass. They need an attorney who knows the probate laws in your state so that all of the legalities are met. They'll likely have to pay the attorney a retainer up front and be reimbursed later unless they already have access to the estates funds which isn't usual.

    You need to look up for your state what the time limit is for filling probate. Some states require the papers to be filied within 30 days, others like mine within 4 years.
    If the executors are not communicating with you - filing probate is a public record and you can usually look up the records on line at the county web site the probate is filed in. If not online, you can go down to the County Clerk's office and find out in person.
    If they don't file by the deadline or won't, then you need to get a lawyer.

    Meantime if you can keep paying any bills or taxes or insurance etc. then do. Usually the funeral home will notify SSA of a person's passing so if she was getting Social Security that should stop. If they direct deposit after a death they will direct undeposit when they find out.

    Thank you all so very, very much. It has not come to funeral home status yet, that will devastate me but I sense the clearing at the end of the Path and I have some peace of mind now.

    While perusing Betts Books on the Wayback Machine, I came across a massive sale with less than 25% of the total collection listed. Look at the listed items (and the quantities of some). 3 complete sets on numbered Plants...Amazing! However, I had not fully committed to returning to SK collecting and this opportunity slipped by. So, I wasn't aware of this sale until recently. Would someone please tell me who this collector was? I've attached the URL, and it seems to work for me. Thanks.

    The Chris Cavaliere collection was about 2-3 years later. But you are right. He had a huge collection. I wish there were more "internet pulls" in the months that followed. It would be great to see what was in the other 40+ boxes.
