I'm not really opposed to someone else portraying the joker. With that said I feel bad for the actor who inevitably is gonna' be compared to Ledger, but I guess they'll no that going in. And I can't...

Just a small correction...he will be the second actor to take an Oscar posthumously. There have been other people who've won for nonacting roles in the film industry.
